RECOMMENDATION

Sheriff requests approval of and authorization for the Chair to sign Amendment No. 3 to Agreement No. 170294B with Bode Cellmark Forensics, Inc., extending the term through June 30, 2023 with an automatic renewal of two additional one-year terms and amending compensation provisions, with no net change to the maximum prepayment amount of $20,000 per fiscal year, for DNA analysis services.

EXECUTIVE SUMMARY
Under this agreement, Bode Cellmark Forensics, Inc. will continue to provide the Sheriff's Office with forensic DNA analysis and research services on submitted samples. The amendment extends the term of the agreement to June 30, 2023 with an automatic renewal provision for two additional one-year terms and amends the compensations provisions for additional DNA services.

Discretionary Justification:
There is no mandate to utilize this specific DNA analysis service. However, the primary alternative through the Department of Justice has a turnaround time of six months or more. Bode has a contractual 30-day turnaround.

Future fiscal impact:
Funding from Proposition 69 revenue is included in the FY 22/23 Approved Budget and will be budgeted accordingly in future fiscal years.
Consequences if not approved:
If not approved, Sheriff's Office would need to utilize an alternate DNA analysis service that has significantly longer processing times.
