EXECUTIVE SUMMARY

Under this agreement, Bode Cellmark Forensics, Inc. will continue to provide the Sheriff’s Office with forensic DNA analysis and research services on submitted samples. The amendment extends the term of the agreement to June 30, 2023 with an automatic renewal provision for two additional one-year terms and amends the compensations provisions for additional DNA services.

Discretionary Justification:

There is no mandate to utilize this specific DNA analysis service. However, the primary alternative through the Department of Justice has a turnaround time of six months or more. Bode has a contractual 30-day turnaround.

Is the general fund affected?

No

Future fiscal impact:

Funding from Proposition 69 revenue is included in the FY 22/23 Approved Budget and will be budgeted accordingly in future fiscal years.

Consequences if not approved:

If not approved, Sheriff’s Office would need to utilize an alternate DNA analysis service that has significantly longer processing times.

ENVIRONMENTAL IMPACT

ENVIRONMENTAL DETERMINATION: The proposed action is not a project as defined by 14 California Code of Regulations 15378 (State CEQA Guidelines) and therefore CEQA is not applicable.

 

BACKGROUND AND DISCUSSION

Bode Cellmark Forensics, Inc. (Bode) serves the law enforcement and identification markets and is unique in that it provides both state-of-the-art human DNA analysis and innovative DNA collection products. Having identified criminals in every U.S. state, as well as victims of war, terrorism, crime and natural disasters, including the 2001 World Trade Center attack and U.S. soldiers dating back to the Vietnam War, Bode is the leader in providing forensic DNA analysis to law enforcement agencies, federal and state governments and disaster management organizations around the world.

Some services utilized by the Napa County Sheriff’s Office include swab and evidentiary submissions of cigarette butts, hats, cans and shell casings. This service has assisted in providing leads for catalytic converter thefts, the identification, arrest and conviction of several felons with stolen firearms, hit-and-run drivers and more.

Today’s requested action is for the approval of Amendment No. 3 to Agreement No. 170294B which extends the term of the agreement to June 30, 2023 with an automatic renewal provision for two additional one-year terms with no net change to the maximum prepayment amount of $20,000 per fiscal year.
