BACKGROUND

The Berryessa Estates subdivision is located on the northwestern side of Lake Berryessa, in the eastern part of Napa County. This unincorporated area experiences hotter summers and colder winters compared to the City of Napa and, as a result, the pavement has suffered from extreme weathering and underlying soil movement. The roadways in the Berryessa Estates were built in 1966 and were last treated in 2010 with a slurry seal. Under this project, 14 roadways will be cleaned of debris, coated with a rubberized asphalt chip seal, and topped with 1-1/2 inches of hot mix asphalt (HMA). Sections of roadways with severe cracking will be crack filled and/or may receive a digout repair. Additional improvements will include repairs to existing drainage systems, installation of new drainage features, raising of utility iron, and upgrading street signs throughout the subdivision.

The Berryessa Estates Paving Project was advertised on March 14, 2024. The Clerk of the Board opened seven (7) bids on April 11, 2024. The bid results of the three (3) apparent low bidders are listed below:

The Engineer’s Estimate of $3,225,000 was based on previous project bid results and Caltrans bids. The three (3) lowest bids have been reviewed and are considered responsive, and staff recommends awarding Bid Alternate 1. Bid Alternate 1 includes an increased pavement section of 2-inches of HMA on Stagecoach Canyon Road and Harness Drive. Bid Alternate 1 was estimated at $190,000.  The bid result was $241,240.

Construction is anticipated to commence in May 2024 and be completed by June 2024, weather permitting.
Goodfellow Brothers CA, Inc. is not a local vendor; however, the Public Contract Code requires that the construction contract be awarded to the lowest responsible and responsive bidder, regardless of whether the low bidder is local or not. Staff reached out to the local construction contractor community by advertising the request for bids in the Napa Valley Register and the Solano-Napa Builder’s Exchange, and by posting on the County website. Staff also sent “Notices to Contractors” to the local construction community.
Agreement No. 240328B with Miller Pacific Engineering Group will provide the County with Construction Management, Inspection, and Testing services through the course of construction. The total project budget, including engineering design, construction management, project management, special inspection, construction, and contingency is $3,700,641. In addition to previous appropriations totaling $70,000, a budget transfer of $3,770,641 from SB-1 ($2,870,000) and ACO ($900,641) is requested to move this project forward to construction.

It is recommended that the Board award the construction contract to Goodfellow Brothers CA, Inc. for their low base bid of $2,659,401, authorize the agreement with Miller Pacific for Construction Management services, approve the budget transfer, and authorize the Chair to sign the construction contract and agreement.

Requested Actions:
1. Award of Contract to Goodfellow Brothers CA, Inc. of Livermore, California for their low base bid of $2,659,401 with Additive Alternate No. 1 of $241,240 to provide the scope of work required for the Berryessa Estates Paving Project and authorize the Chair to sign the construction contract;
2. Approve and authorize Agreement No. 240328B with Miller Pacific Engineering Group; and
3. Approve a Budget Amendment for the following (4/5 vote required):
   a. Increase Transfer Out appropriations by $2,800,000 in the SB-1 Non-Operating Special Revenue Fund (Fund 2440, Sub-Division 1220052, Account 56100) (SB-1 SRF) offset by use of its available fund balance to transfer to Project 22030; and
   b. Increase Transfer Out appropriations by $900,641 in the Capital Improvement Projects Fund (Fund 3000, Sub-Division 3000000, Account 56100) (CIP) offset by use of its available fund balance to transfer to Project 22030; and
   c. Increase Construction Services appropriations by $3,530,641 in Project 22030 budget (Fund 2040, Sub-Division 2040500, Project 22030, Account 52360) offset by Transfer In revenue from SB-1 SRF and CIP; and
   d. Increase Engineer Services appropriations by $170,000 in Project 22030 budget (Fund 2040, Sub-Division 2040500, Project 22030, Account 52145) offset by Transfer In revenue from SB-1 SRF.

Discretionary Justification:

The proposed project will resurface 14 roadways, provide better rideability, and extend the pavement life of roads throughout the Berryessa Estates Subdivision. The requested approvals and budget amendment will allow for construction of necessary repairs for this project.

Is the general fund affected?

No

Future fiscal impact:

Construction is projected to begin and end in Fiscal Year 2023-24.

Consequences if not approved:

The project will not move forward to the construction phase and the damaged roads will not be repaired. Some roads will eventually fail, and the County will be required to reconstruct the roads, which will greatly impact the users of these facilities and significantly increase the cost of repairs.

 

ENVIRONMENTAL IMPACT

ENVIRONMENTAL DETERMINATION: Consideration and possible adoption of a Categorical Exemption Class 1: It has been determined that this type of project does not have a significant effect on the environment and is exempt from the California Environmental Quality Act. [See Class 1 (“Existing Facilities”) which may be found in the guidelines for the implementation of the California Environmental Quality Act of 14 CCR § 15301; see also Napa County’s Local Procedures for Implementing the California Environmental Quality Act, Appendix B].
