Interim Director of Planning, Building and Environmental Services requests adoption of a Resolution authorizing the submission of an application to the California Department of Resources Recycling and Recovery (CalRecycle) for a Waste Tire Enforcement Grant in the amount of $60,199 for the State’s Fiscal Year 2022-2023 award cycle to be received in County Fiscal Year 2023-2024 and authorization for the Interim Director or designee to execute the necessary grant documents.

EXECUTIVE SUMMARY
The Waste Tire Enforcement Grant will provide the Napa County Solid Waste Local Enforcement Agency (LEA) resources to survey, analyze, and inspect tire dealers, auto dismantlers and other businesses for the ongoing environmental health and safety problems of hauling and storing waste tires. The LEA has worked closely with CalRecycle waste tire staff in the inspection of waste tire generating businesses to ensure proper transport and disposal of waste tires. The grant program is currently on a 1-year cycle, with the same application required every year. The State requires a Board resolution authorizing the submittal of an application.

Consequences if not approved: |
The LEA would not receive the grant award and would not be able to perform waste tire inspections, educate businesses on proper regulatory standards for hauling waste tires, nor identify and assist businesses in removing large waste tire piles that can cause a threat to the environment. |

ENVIRONMENTAL IMPACT
ENVIRONMENTAL DETERMINATION: There is no possibility the proposed action may have a significant effect on the environment and therefore CEQA is not applicable pursuant to the General Rule contained in the Guidelines for the Implementation of the California Environmental Quality Act, 14 CCR 15061 (b)(3).
BACKGROUND AND DISCUSSION
The Waste Tire Enforcement Grant will provide the Local Enforcement Agency (LEA) resources to survey, analyze, and inspect tire dealers, auto dealers, auto-dismantlers and other businesses for the ongoing environmental health and safety problems of hauling and storing waste tires. The LEA has worked closely with CalRecycle Waste Tire staff in regulating illegal tire storage piles at several auto-dismantling businesses and successfully coordinated cleanup of other illegally disposed tires at locations throughout the County. The LEA will specifically be inspecting businesses as a surveillance and enforcement activity, reinforcing the current regulations and importance of legally hauling and storing of waste tires. Any persons violating the waste tire regulations will be issued notices of violation and possible referral to CalRecycle for appropriate enforcement. The previous grant cycles have been effective in identifying and noticing businesses on the appropriate management of waste tires. The grant program is currently on a one-year cycle; same application, reapplication every year.
CalRecycle requires the resolution and grant submittal in Fiscal Year 2022-2023. This is the fiscal year CalRecycle will award the grant and initiate allocation of funds to grantees. If awarded, the LEA will implement and receive cost reimbursement in the Fiscal Year 2023-2024, which is the grant performance period.
