EXECUTIVE SUMMARY

California Assembly Bill 177 (2021) eliminated the ability for local counties to impose administrative fees on the cost of collecting restitution fines. GC Services manages victim restitution on behalf of Napa County. Since administrative fees can no longer be collected the County is revising the agreement with GC Services to cover the cost of the administrative expenses of victim restitution.

BACKGROUND AND DISCUSSION

California Assembly Bill 177 (2021) eliminated the ability for local counties to impose administrative fees on the cost of collecting restitution fines.

Penal Code 1202.4(1) gave authority to local county governments to collect administrative fees:
At its discretion, the board of supervisors of a county may impost a fee to cover the actual administrative cost of collecting the restitution fine, not to exceed 10 percent of the amount ordered to be paid, to be added to the restitution fine and include in the order of the court, the proceeds of which shall be deposited in the general fund of the county.

GC Services manages victim restitution on behalf of the County. Since administrative fees can no longer be collected, the County is revising the agreement with GC Services to cover the administrative expenses.

The scope of services and pricing details of the contract are changing to reflect the changes due to AB177. The contract is increasing by an amount not to exceed $100,000 annually.

On May 7, 2019, the Board of Supervisors approved an agreement with GC Services to collect restitution for victims of crimes through December 31, 2023 with an option to extend the agreement an additional five years.
