EXECUTIVE SUMMARY

Approval of the requested Amendment No. 6 will:
1.  Increase the amount by $19,880 for a new contract maximum of $45,000, and each automatic renewal thereof, to accommodate an increase of referrals for Conservatorship Investigation services;
2.  Replace Exhibit A-3 and all previous versions of Exhibit A with Exhibit A-4 (Scope of Work) to revise the beginning date of the term to January 1, 2022, and each automatic renewal thereof; and 
3.  Replace Exhibit B-3 and all previous versions of Exhibit B with Exhibit B-4 (Compensation) to reflect a rate increase from $160 per hour to $185 per hour.

Future fiscal impact:

The Agreement contains a provision for automatic annual renewal. Appropriations have been included in the approved Fiscal Year 2021-2022 budget and future fiscal years will be budgeted accordingly.

Consequences if not approved:

This Agreement helps ensure that the County meets the requirements of the Welfare and Institutions (W&I) Code Sections 5350 and 5352. This requires the County to provide an officer to investigate requests for temporary, permanent and Murphy conservatorships.

ENVIRONMENTAL IMPACT

ENVIRONMENTAL DETERMINATION: The proposed action is not a project as defined by 14 California Code of Regulations 15378 (State CEQA Guidelines) and therefore CEQA is not applicable.

 

BACKGROUND AND DISCUSSION

Welfare and Institutions (W&I) Code Sections 5350 and 5352 requires the County to provide an officer to investigate requests for temporary, permanent, and Murphy conservatorships. Conservatorship investigations are necessary to provide the Courts with the comprehensive information they need to make critical decisions regarding mentally ill persons’ need for conservatorship.  These investigations are also necessary to ensure individualized treatment, supervision, and placement for mentally ill persons unwilling or incapable of accepting treatment voluntary.

Dr. Geisler provides investigation services for temporary, permanent, or Murphy conservatorships. The services provided under this Agreement include consultation, client interviews, medical and psychiatric review of records, report preparation, and court appearances, as necessary.

Approval of the requested amendment will revise the Compensation Exhibit to incorporate a rate increase from $160/hr. to $185/hr. for time spent on contract service activities. The only change on Exhibit A is a revision to the date. Lastly, to accommodate more referrals for Conservatorship Investigation services, a contract maximum increase of $19,880 is necessary to cover both the rate increase and provider services for the rest of the fiscal year.
