RECOMMENDATION

Director of Public Works requests the following actions regarding a parcel of land:

1.                     Acceptance of a donation of a 0.27 acre parcel (APN 025-365-001) valued at $2,700 located between Silverado Trail and the Napa River, from the Pestoni Family Estate;

2.                     Authorization for the Chair to sign a letter of appreciation in acceptance of the donation; and

3.                     Authorization for the Director of Public Works to sign all required documents to effect the transfer of ownership of the subject parcel.

EXECUTIVE SUMMARY

The Pestoni Family Estate has offered donation of a 0.27 acre parcel located near St. Helena, between Silverado Trail and the Napa River.  This sliver of land is unusable/unbuildable from a development standpoint, but could be very useful to the County in maintaining Silverado Trail, and particularly if there is another landslide in this area, similar to the slide that occurred on October 28, 2021 in the same general area. As there is little cost to the County, Staff recommends the Board accept this donation.

Yes

Is it currently budgeted? Yes  Where is it budgeted? Staff recommends splitting the closing costs with the donator.  These minor costs (<$500) can be covered by the existing Roads budget.     Is it Mandatory or Discretionary? Discretionary  Discretionary Justification: Approval of these item will allow the County to receive a potentially very useful piece of land at minimal cost.   Is the general fund affected? No  Future fiscal impact: None  Consequences if not approved: The County would not accept this donation

ENVIRONMENTAL IMPACT

ENVIRONMENTAL DETERMINATION: The proposed action is not a project as defined by 14 California Code of Regulations 15378 (State CEQA Guidelines) and therefore CEQA is not applicable.

 

BACKGROUND AND DISCUSSION

In accordance with Board Resolution No. 05-40 and the Recommended Procedure for the Acceptance and Disbursement of Gifts, Bequests, or Devices for Donation in excess of $1,000, this agenda item has been prepared to accept a donation of land valued at $2,700 from the Pestoni Family Estate and to send a letter of appreciation for this generous contribution.

The Pestoni Family Estate has offered donation of a 0.27 acre parcel located near St. Helena, between Silverado Trail and the Napa River.  An appraisal of the parcel is attached, as is a figure showing the location of the parcel.  This sliver of land is unusable/unbuildable from a development standpoint, but could be very useful to the County in maintaining Silverado Trail, and particularly if there is another landslide in this area, similar to the slide that occurred on October 28, 2021 in the same general area.

As there is only a minor cost to the County to accept the parcel, and the land requires no particular maintenance, Staff recommends the Board accept this donation.
