Director of Planning, Building and Environmental Services requests acknowledgement of the withdrawal filed on July 10, 2021 by Rob Anglin, Esq. on behalf of Staglin Family Vineyard, LLC (the applicant/Appellant) and Edward Schexnayder, Esq. on behalf of the neighbors, Rutherford Bench Alliance (Appellant) to the Planning Commission's March 3, 2021 approval of Use Permit Major Modification No. P18-00253-MOD for the Staglin Family Vineyard.

EXECUTIVE SUMMARY
On July 10, 2021, the Clerk of the Board received a letter signed by both parties withdrawing their respective appeals (Attachment A). Pursuant to County Code Section 2.88.060(B), withdrawal of an appeal is effective upon receipt and therefore the appeal was withdrawn as of July 10, 2021.

ENVIRONMENTAL DETERMINATION: The proposed action is not a project as defined by 14 California Code of Regulations 15378 (State CEQA Guidelines) and therefore CEQA is not applicable.
BACKGROUND AND DISCUSSION
A public hearing on the appeals was opened on June 15, 2021 and continued with the consent of staff, Applicant/Appellant and Appellant to September 28, 2021. On July 10, 2021, the Clerk of the Board received a letter signed by both parties withdrawing their respective appeals (Attachment A). Pursuant to County Code Section 2.88.060(B), withdrawal of an appeal is effective upon receipt and therefore the appeal was withdrawn as of July 10, 2021.
