EXECUTIVE SUMMARY

On February 23, 2021 the Board of Supervisors approved plans and specifications for the "Napa River Oakville to Oak Knoll Reach Site 9 Grading and Group D Revegetation" PW 21-15 and authorized Public Works to advertise for sealed bids and for opening of the bids at a time, date, and location to be published by the Director of Public Works pursuant to Section 20150.8 of the Public Contract Code. Bids were opened on April 15, 2021 with the apparent low bidder being Siteworks Construction Inc. of Lafayette, CA, for their for their low total bid of $3,080,933 including an Option Item 1 price of -$77,777. Staff is recommending award of the contract without Option Item 1 for a total contract amount of $3,158,710. Siteworks Construction Inc. is not        a local vendor. The Project is funded by grants from the Coastal Conservancy, California Department of Fish and Wildlife, and local funding through Measure A.

At the May 5th, 2020 Board meeting, the Board of Supervisors approved resolution 2020- 61 to accept $800,000 in grant funds for the OVOK project. The State Water Resources Control Board (Water Board) requested minor modifications to the resolution. Staff is recommending the original resolution be rescinded, and approval of this updated resolution as requested by the Water Board.

Where is it budgeted?                     Public Works Projects Fund 1000, Subdivision 1220500, Program 07002. Project is funded by grants from the Coastal Conservancy, California Department of Fish and Wildlife, and local funding through Measure A.

Is it Mandatory or Discretionary?                                                               Discretionary

Discretionary Justification:                     The project is a continuation of the Napa River Restoration Projects to enhance the riparian environment and reduce sediment loads into the river.

Is the general fund affected?                                                               No

Future fiscal impact:                     The grading project is anticipated to be complete in 2021. Revegetation and maintenance will be a responsibility of the contractor for an additional three years. Following construction, long term maintenance is being funded by the OVOK Community Facilities District that was created by the Flood Control District.

Consequences if not approved:                     If this item is not approved, potential loss of grant funds, landowner involvement and continued degradation of the Napa River can occur.

ENVIRONMENTAL IMPACT

ENVIRONMENTAL DETERMINATION: The project is the subject of a Mitigated Negative Declaration (SCH No. 2014012057), which was adopted by the Napa County Public Works Director on April 11, 2014. According to the Mitigated Negative Declaration, the proposed project would have, if mitigation measures are not included, potentially significant environmental impacts in the following areas: Aesthetics, Biological Resources, Transportation/Traffic, Cultural Resources, and Air Quality. This project site is not on any of the lists of hazardous waste sites enumerated under Government code section 65962.5. Project permit obtained from the United States Army Corps of Engineers will include additional environmental evaluations to comply with NEPA as may be needed if Federal grant funds are used to fund future construction efforts.

 

 

BACKGROUND AND DISCUSSION

The Napa River Oakville to Oak Knoll Reach Site 9 Grading and Group D Revegetation Project will continue activities to reduce sediment loads and enhance biological complexity throughout the river channel similar to those performed in the recently completed Rutherford Reach Restoration Project. The OVOK project spans approximately 9.5 miles, beginning south of Oakville Crossroad and ending near Oak Knoll Avenue. Specific restoration sites have been identified and organized into construction Groups A, B, C, and D. Due to limitations in restoration funding for these sites, construction of the four groups is not sequential. Group A is complete and now in long-term maintenance.

Groups C, and B are currently funded and in various stages of construction as outlined below. Most of the Group D sites started construction in 2020 and will be finished this year. Site 9 was split out from the rest of Group D and is being bid with the Group D Revegetation work in the subject project. The Site 9 Grading and Group D Revegetation Project has been bid and is now ready to be awarded. The attached map shows the locations of the construction sites associated with each group.

 

Group A

Construction of Group A was completed in summer 2016 and revegetation began in the fall 2020.

 

Group C

Construction of Group C was completed in 2018 and is currently in a revegetation phase which will end in 2021.

 

Group B

Construction of Group B was completed in 2019 and is currently in a revegetation phase which will end in 2023.

 

Group D

Construction of Phase I was completed in 2020 and Phase II will begin in summer 2021. After construction is complete the sites will enter a three year revegetation phase.

 

Site 9 Grading and Group D Revegetation (The subject of this Item)

Site 9 will be constructed in summer 2021. Once it is complete, it will be added to the ongoing revegetation efforts for the rest of the Group D Sites. The Site 9 project involves grading the river channel to create diversity and to reconnect the waterway to its historic floodplain. The planned habitat structures and erosion protection will allow for a healthier ecosystem without creating additional risk to landowners in the area. The revegetation work will remove invasive plant species and replace them with native vegetation that has been propagated from the Napa River Watershed. The new plantings will be monitored and maintained over a 3-year period to assure that they are properly established.

 

The Engineer's estimate for construction of the base contract was $2,556,412.  The following are the three lowest total bids:  Contractor

It is recommended that Option Item 1, which would have allowed moving construction of Site 9 to the 2022 construction season, for the    amount of -$77,777, not be awarded due to higher staff, consultant, and other incidental costs which would be expected to accrue which would more than offset the discount. This option item was included in the total bids listed above. This recommended award would make the contract a total of $3,158,710.

 

Siteworks Construction Inc. is not a local vendor. Public Contract Code requires that the construction contract be awarded to the lowest responsible and responsive bidder regardless of whether the low bidder is local or not. Staff outreach to the local construction contractor community included advertising the request for bids in the Napa Valley Register, the Solano-Napa Builders Exchange and posting on the County website. Staff also sent "Notices to Contractors" to local contractors to let them know about the bidding opportunities. Once the construction contract is awarded the County will contact the Napa County Workforce Investment Board (WIB) and will require the successful contractor to contact the WIB to let the WIB know of its hiring needs.

Construction of Site 9 will take one year and will take place in 2021. The revegetation work will start immediately. After the initial planting work is completed on each site, a three year maintenance period starts after which the project is complete. This phase of the OVOK Project is being supported by grant funding from the California State Coastal Conservancy and the California Department of Fish and Wildlife with funds being matched by Measure "A".

The Board of Supervisors previously approved resolution 2020- 61 to accept $800,000 in grant funds from the Water Board for the OVOK project, at the May 5th, 2020 Board meeting. Along with grant funds from the California Department of Fish and Wildlife, the California Coastal Conservancy, Environmental Protection Agency, California Wildlife Conservation Board and matching funds from Measure A, the funding from the Water Board will support implementation of Group D in 2021. Measure A matching funds for this project have already been approved by the Board as part of Amendment No. 27 of the funding agreement with the Flood Authority.

The Water Board has updated the language that it requires grantees to include in a resolution to accept grant funds. The Water Board is requiring the County to execute a resolution that includes the updated language. At this time, staff is recommending rescission of the old resolution and approval of this revised resolution using the updated resolution template required by the State Water Resources Control Board.
