SUBJECT: Amendment No. 1 to Lease Agreement No. 240114B (formerly 7845) with Progress Foundation for use of County Facility located at 1046 Bella Drive
RECOMMENDATION

Director of Public Works requests approval of and authorization for the Chair to sign Amendment No. 1 to Lease Agreement No. 240114B (formerly 7845) with Progress Foundation for the County-owned facility located at 1046 Bella Drive in Napa, to:
1. Extend the term to be automatically renewed and coterminous with Service Agreement No. 220003B and any amendments thereto;
2. Modify the rental rates for a new reimbursement monthly amount to the County of $1,528; and
3. Include a five percent (5%) annual rent increase thereafter, not to exceed legal limits.

EXECUTIVE SUMMARY
Currently, Progress Foundation leases the County-owned facility located at 1046 Bella Drive in Napa to house a Transitional Residential Program for the County of Napa Health and Human Services Agency. Approval of Amendment No. 1 to Lease Agreement No. 240114B will enable continued use of this space to be coterminous with Service Agreement No. 220003B, and any amendments thereto, or successor agreements that provide the same or substantially similar services.
In addition, the amendment raises the monthly rent from $1,456 to $1,528 in FY23/24 and continues to implement a 5% annual adjustment during the term of the agreement, not to exceed the annual Napa High HOME rent limit, which as of 2023 is $3,936.
