RECOMMENDATION

title

Acknowledge applicant Niebaum-Coppola Estate Winery LP’s withdrawal of Use Permit Exception to the Conservation Regulations Application No. P22-00404-UP for the Inglenook Residence which was the subject of Water Audit California’s appeal. (No Fiscal Impact)

body

BACKGROUND

Water Audit of California (WAC) filed an appeal on December 11, 2023, regarding the Planning Commission’s approval of Use Permit Exception to the Conservation Regulations Application No. P22-00404-UP for the Inglenook Residence.  For over a year, the parties have attempted to resolve the appeal and the Board continued the public hearing multiple times to accommodate their efforts. Ultimately the negotiations were unsuccessful and Applicant has voluntarily withdrawn the application which renders the Use Permit approval null and void, and the appeal moot.

The Board no longer has jurisdiction over the matter. Because the hearing was continued to today’s meeting, this item appears on the consent agenda for record keeping and tracking purposes only.  Since the Application has been withdrawn there is no public comment or action to be taken by the Board of Supervisors.
