BACKGROUND
The Napa Logistics Park Phase 2 developer was conditioned by the City of American Canyon (City) through the use permit process to make improvements to South Kelly Road between SR-29 and Devlin Road, the intersection of SR-29 and South Kelly Road, and the intersection of Devlin Road and South Kelly Road. The developer provided the City with preliminary street improvement plans, cost estimates, and fair-share funds for the completion of the conditioned improvements. The City has created the South Kelly-Highway 29 Intersection project to deliver the aforementioned improvements. The City and Napa County each have jurisdiction over portions of South Kelly Road and both agencies desire to partner for the overall improvement of the road in whole. For economies of scale, the City and County will also include rehabilitating Tower Road which is owned by Napa County.
The City owns the eastbound lane of South Kelly Rd. (i.e. south of the centerline), while the County owns the westbound lane (north of the centerline). Accordingly, expenses for this portion of the project will be split roughly equally, using Capital Improvement Funds (a portion of the $20 million the Board committed to Roads in 2021). Tower road is solely owned by the County, so the County will fund 100% of that project, using Zone 1 Franchise Fee funds. Public Works is creating two project numbers to keep these fundings separated during the project.
The project will be managed by the City in conjunction with Napa County. The City will work with BKF Engineers to provide engineering services, and Napa County will reimburse the City for its fair share of services. Today’s action will create the project and facilitate the cooperation between the City and the County to continue with project design. The funding requested will also fund staff time for project management and coordination with the City through the design and bidding phases. Staff will return to the Board with another budget transfer request for award of construction contract to fully fund the project including construction administration, inspections and testing.
Requested Actions:
1. Approval of Budget Amendment for the following (4/5 vote required)
a. Increase Transfer Out appropriations by $69,864 in the Capital Improvement Projects Fund (Fund 3000, Sub-Division 3000000, Account 56100) offset by use of its available fund balance to transfer to project 25023;
b. Increase Transfer Out appropriations by $130,136 in the Zone-1 Garbage Fund (Fund 2180, Sub-Division 2180000, Account 56100) offset by use of its available fund balance to transfer to project 25029;
c. Creation of a new Roads Capital Improvement project for the “South Kelly Road Paving Project” (Fund 2040, Sub-Division 2040500, Project 25023) and increase Engineer Services appropriations for project design and road paving repair by $69,864 (Fund 2040, Sub-Division 2040500, Project 25023, Account 52145) offset by a transfer-in revenue from the Capital Improvement Projects Fund; and
d. Creation of a new Roads Capital Improvement project for the “Tower Road Paving Project” (Fund 2040, Sub-Division 2040500, Project 25029) and increase Engineer Services appropriations for project design and road paving repair by $130,136 (Fund 2040, Sub-Division 2040500, Project 25029, Account 52145) offset by a transfer-in revenue from the Zone-1 Garbage Fund.
2. Approve and authorize Agreement No. 250311B with the City of American Canyon, a municipal corporation for a maximum of $124,013 for City reimbursement from Napa County for roadwork on South Kelly and Tower Road within the County limits.

ENVIRONMENTAL IMPACT
ENVIRONMENTAL DETERMINATION: The proposed action is not a project as defined by 14 California
Code of Regulations 15378 (State CEQA Guidelines) and therefore CEQA is not applicable.
