BACKGROUND
In 1997, the Board of Supervisors added Chapter 8.48 to the Napa County Code of Ordinances pertaining to solid waste franchises. Section 8.48.030 provides that the Board may, by resolution, define the boundaries of the franchise zones within the unincorporated area of the county for the handling, collection, transportation and disposal of solid waste in order to promote health, safety, and welfare and to protect the environment in the sparsely populated and rural area of Napa County.
Napa County Recycling and Waste Services (NCRWS) provides service in the area identified as franchise Zone One. There are currently 4,400 residential and 313 commercial customers in Zone One. The proposed expansion of the franchise service area will add an additional 20 residential and 10 commercial customers. Approval of the expanded Zone One boundary would bring these additional customers into Zone One and guarantee landfill, organics and recycling service.
When first adopted in 2005, franchise Zone One included most of the areas that are proposed to be added to the franchise area. These areas were removed from the franchise zone in 2013 at the request of NCRWS and are currently being served by Recology American Canyon (Recology). Recology notified NCRWS of its plans to discontinue providing service to County customers that were not covered by their franchise agreement with the City of American Canyon. NCRWS would like to provide the service to these customers.
There is a historically non-franchised area that is proposed to be added into the franchise area. It is the area to the east of the city limits of the City of American Canyon and just south of the City of Napa limits. It is largely undeveloped. Customers would be negatively impacted if a service provider was not willing to service the area. Bringing this area into franchise Zone One will ensure landfill, organics and recycling services for residential and commercial customers in the area.
The expanded Zone One will include clusters of residential and commercial collection within the unincorporated areas near Green Island Road, American Canyon Road, Lynch Road and Watson Lane. A map delineating the proposed expanded Zone One is attached as Exhibit D-1 of the Resolution.
The adjustments to franchise Zone One are as follows:
The boundaries of the entirety of Zone One are identified in the new legal description that is attached and incorporated as Exhibit D-1 of the Resolution and Amendment adjusting the Service Area.
The new areas added to Zone One are those shaded in hatched blue as identified on the map attached by reference as Exhibit D-1 of the Resolution and Amendment adjusting the Service Area.
The County receives franchise fee revenue that equals 10% of the gross revenue collected by NCRWS. Franchise fee revenue is currently estimated to be an average of $69,591 monthly and is recorded in the Zone 1 Garbage special revenue fund. The franchise fees are utilized to reimburse the County for expenses incurred related to franchise Zone 1. This includes public education, business assistance for compliance with state recycling laws and monitoring needed to ensure compliance with state recycling laws. This action would increase the County's franchise fee revenue by 0.57%, or approximately $4,800 a year.
