Intent to adopt an Ordinance amending Title 2 (Administration and Personnel) Article III (Terms of Employment) and amending language in Chapter 2, Section 100.235 (Administrative leaves of absence with pay) of the Napa County Code regarding giving the Director of Human Resources additional authority to grant paid leaves of absence.

BACKGROUND

The draft ordinance proposes to amend Napa County Code 2.100.235 to increase the amount of time the Human Resources Director can grant employees paid leaves of absence.  This section is typically used when employees are involved in matters requiring an investigation. Currently, employees may be placed on an administrative leave of absence with pay for up to three workdays by the Department Head with approval from the Human Resources Division and 20 additional workdays may be granted by the Department Head with the approval of the County Executive Officer for a total of 23 workdays. Further extensions require Board approval.

This request allows for employees to be placed on an administrative leave of absence with pay for up to three workdays, with authority given to the Director of Human Resources to grant an additional 60 days leave of absence. The Director of Human Resources can grant an additional 30 days leave of absence with approval from the County Executive Officer. Further extensions continue to require this Board’s approval. The requested amendment allows for those handling the investigation to determine an appropriate amount of leave and reduces the amount of administrative work required to request extensions.

Consequences if not approved:

Employees involved in matters requiring an investigation or in situations where it is in the County’s best interest would be on paid administrative leave for a short period of time during lengthy investigations causing employees to go into an unpaid status sooner which leads to a loss of benefits. More frequent extension requests will be brought to this Board requiring administrative time.

 

ENVIRONMENTAL IMPACT

ENVIRONMENTAL DETERMINATION: The adoption of this ordinance is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15061(b)(3) (there is no possibility the activity in question may have a significant effect on the environment).
