BACKGROUND
Napa Valley Community College District (District) opened the River Trail Village student housing complex in the fall semester of 2024. The District’s 24-hour law enforcement services are provided by the Napa Valley Community College Police Department (NVCPD). The opening of the new student housing has created a staffing shortage. To supplement the staffing shortage, the District has sought out additional law enforcement services with the Napa County Sheriff's Office.
Although NVCPD has primary law enforcement jurisdiction on campus, under the Kristin Smart Campus Safety Act of 1998 (Education Code section 67381), the District is required to establish a Memorandum of Understanding (MOU) with local law enforcement agencies to clarify agency jurisdiction and for the investigation of specified Part 1 Violent Crimes listed under this Act.
Part 1 Violent Crimes include homicide, forceable rape, robbery, felony aggravated assault, crimes against children, driving under the influence, kidnapping, major injury accidents, felony sexual assault, and hate crimes. The District’s previous MOU was with the Napa City Police Department, which did not include additional patrol services.
Due to the District’s staffing shortages, Sheriff’s Office proposes to provide law enforcement patrols of the River Trail Village student housing complex, and surrounding areas at the college, including housing, courtyards, parking, and surrounding walkways. During the weekdays, patrol services will be provided Monday through Friday, between 12:00 a.m. and 5:30 a.m. and during the weekends, patrol services will be provided on Saturday and Sunday, between the hours of 6:00 p.m. and 7:00 a.m. In addition to these patrol services, Sheriff’s Office will also provide investigative services for Part 1 Violent Crimes as specified in the Kristin Smart Campus Safety Act.
District may request investigative assistance from Sheriff’s Office for crimes other than those that are identified in Part 1 Violent Crimes, subject to the approval of the Sheriff or Undersheriff. Both parties agree that the Sheriff’s Office will have and retain discretion to determine the level of support required to ensure effective law enforcement response to any given situation.
Requested Action:
Approve and authorize the Chair to sign revenue Agreement No. 250324B with the Napa Valley College District in the amount of $49,210 for the term August 14, 2024, through July 31, 2025, for the provision of law enforcement services for the student housing complex and surrounding areas.

Discretionary Justification: |
This item is discretionary as in there is no mandate for the Sheriff’s Office to provide municipal law enforcement services to the District. Under this agreement, District reimburses the County for the costs of law enforcement services plus administrative overhead expenses. |

Consequences if not approved: |
If the Agreement is not approved, Sheriff’s Office would not provide law enforcement services to the District. Due to low campus police department staffing, District would not have law enforcement coverage 24 hours a day. Other law enforcement agencies are not available to provide service coverage. |

ENVIRONMENTAL DETERMINATION: General rule.
