RECOMMENDATION

Director of Public Works requests the following actions:
1. Award of a contract to Azul Works Inc., of San Francisco, California for their low base bid of $765,790 and authorize the Chair to sign the construction contract for the Partrick Road Bridge Repair, RDS 20-12 project; and
2. Approval of a Budget Amendment for the following (4/5 vote required):
a. Increase Transfers Out appropriations by $1,098,948 in the Accumulated Capital Outlay Fund (ACO) (Fund 3000, Sub-Division 3000000, Account 56100) with the use of its available fund balance to be transferred to Project R8020, Partrick Road Bridge MPM 0.88; and
b. Increase Construction Services appropriations by $1,098,948 in Project R8020 (Fund 2040, Sub-Division 2040500, Project R8020, Account 52360) offset by a transfer-in revenue from the ACO.

EXECUTIVE SUMMARY
Partrick Road Bridge was damaged in the 2014 South Napa Earthquake and has since been out of service while a temporary bridge is handling traffic. Bids have been opened for the repair project and it is recommended that the Board award the contract to Azul Works for their low bid of $765,790, approve the Budget Amendment, and authorize the Chair to sign the construction contract.

ENVIRONMENTAL IMPACT
ENVIRONMENTAL DETERMINATION: Consideration and possible adoption of a Categorical Exemption Class 1: It has been determined that this type of project does not have a significant effect on the environment and is exempt from the California Environmental Quality Act. [See Class 1 (“Existing Facilities”) which may be found in the guidelines for the implementation of the California Environmental Quality Act at 14 CCR §15301; see also Napa County’s Local Procedures for Implementing the California Environmental Quality Act, Appendix B.]
BACKGROUND AND DISCUSSION
Partrick Road Bridge was initially constructed in the early 1900’s and later retrofitted in the 50’s. The 17-foot-wide bridge served well until damaged in the 2014 South Napa Earthquake. After that the bridge was evaluated, it was determined that the compromised bridge had a reduced load capacity, and a temporary solution was needed to allow for the safe passage of emergency vehicles and the public. A temporary bridge was installed but does not set on a permanent foundation and although it has been working well, needs to be replaced. After completion of these permanent repairs, the temporary bridge which was purchased by the County will be retained for use in future emergencies.
The proposed repair consists of concrete casted in drilled holes capped with a reinforced concrete beam/abutment supporting a new steel truss bridge. This 60-foot-long bridge is 20 feet longer than the temporary bridge it will replace to promote stability and facilitate repairs with minimal road closure, although closure will be needed. The new bridge has a width of 18 feet which is 1 foot wider than the bridge damaged in the earthquake and approximately the same width as the existing roadway in the area. Although FEMA could have considered the extra width a betterment they did not because the prefabricated bridge is only available in certain standard sizes. County standards for newly constructed bridges is to have 24 feet between the guardrails on the deck but increasing this dimension by 7 feet at the existing site would certainly be considered a betterment by FEMA and make permitting and construction significantly more difficult and costly because it would drive work into the creek.
FEMA has obligated $1,072,764 for the design and construction services needed to complete this project. FEMA will not obligate any funding toward contingency prior to construction however an additional $153,158 is needed for construction contingency. If this contingency is used to deliver the project, the County will later be able to request funding from FEMA for it as part of the project closure process.
On August 9, 2023, the Board approved advertising this project and on October 26, 2023, the following bids were received.

The low bidder’s proposal of $765,790 compares well with the engineers estimate of $800,000 which was calculated when the project was designed. Although construction is anticipated to commence in mid-April of 2024 and be completed by June 11, 2024 the prefabricated bridge will be ordered at least three months ahead of the start of construction. A 20% contingency for unforeseen items is requested which is a little higher than normal because of the complexity of the project and drilling near the creek early in the year. The total project budget with the addition of engineering design, construction management, project management, special inspection and contingency is $1,438,756 and a budget transfer will be funded with ACO funds (see attached project budget). If approved, reimbursement will up to 75% of project costs from FEMA and 18.75% from CalOES.
Azul Construction is not a local vendor however, they do have an office in Napa County. FEMA and the Public Contract Code requires that the construction contract be awarded to the lowest responsible and responsive bidder regardless of whether the low bidder is local or not. Staff reached out to the local construction contractor community by advertising the request for bids in the Napa Valley Register and the Solano-Napa Builder's Exchange, and by posting on the County website. Staff also sent "Notices to Contractors" to the local construction community.
