BACKGROUND

Since January 24, 2012, under Lease Agreement No. 170064B, Napa County has leased space at 1834 Soscol, Suite A for the Probation Department to operate an Evening Reporting Center (ERC) for youth. The ERC serves as a community-based alternative to detention in Juvenile Hall and provides supervision to medium to high-risk youth between the ages of 14 and 17 years old.

Lease Agreement No. 170064B has been amended six times to extend the term and adjust monthly rent. The Agreement is due to expire on January 31, 2025.

Requested Action:
1. Approve and authorize Amendment No. 7 to Lease Agreement No. 170064B with James B. Duncan and Nancy A. Duncan to extend the term of the lease agreement through January 31, 2027, with a 3% annual increase to the monthly rental fee, for a new monthly rental fee of $3,890 in FY 25 for space located at 1834 Soscol Avenue, Suite A.

Is it Mandatory or Discretionary?

Discretionary

Discretionary Justification:

This item is discretionary in that there is no mandate to spend funds in this manner. However, use of State realignment funds, Youth Offender Block Grant (YOBG), will be used for the provision of rehabilitative and supervision services to youthful offenders. These funds continue to be used for leased space to provide services to medium- to high-risk youth in the community.

Is the general fund affected?

No

Future fiscal impact:

Appropriations for lease payments will be budgeted accordingly in future fiscal years. The Department anticipates funding to continue from State realignment funds. Prior to the end of the lease extension, the Department will reassess program needs and reevaluate the lease term.

Consequences if not approved:

If the item is not approved, the Probation Department will not be able to provide highly structured evidence-based programming and pro-social services to medium- to high-risk youthful offenders. It would be difficult to find an alternative location to serve these youth after school hours that meets the size, function, and location needs of the Department.

ENVIRONMENTAL DETERMINATION: The proposed action is not a project as defined by 14 California Code of Regulations 15378 (State of CEQA Guidelines) and therefore CEQA is not applicable.
