BACKGROUND
Today’s action will approve a professional services agreement with Fortify Fire Protection effective June 2, 2026, with a maximum compensation amount beginning in fiscal year 2026-27 through fiscal year 2028-29 of $16,000 for both Routine Service and Non-Routine services with the provision for two one-year automatic renewal options.
Napa County’s current agreement for fire alarms systems testing, inspection, and maintenance services is expiring as of June 30, 2026. As part of a competitive procurement process and in accordance with County purchasing policy, County staff issued a Request for Proposal (RFP No. PMI122501) for these services on December 3, 2025. Eight companies submitted proposals in response to the RFP. The proposals were scored according to predetermined weighted criteria: company history, experience, qualifications, approach to scope of work, and pricing. Fortify Fire Protection distinguished themselves as the most qualified company and was selected by the panel to provide Napa County with contracted fire alarms systems testing, inspections, and maintenance services.
Excluded from scope of work in Napa County Agreement No. 260308B is work done at the Napa County Detention and Rehabilitation Center, located at 2210 Napa Vallejo Highway, Napa, CA. Due to differences, contract language, and separate contract review agencies, a separate agreement resulting from RFP No. PM122501 has been developed with Fortify Fire Protection. The Department of Public Works prepared Agenda Item No. 26-973 to approve Agreement No. 260308B with Fortify Fire Protection.
The State of California pledged $22.8 million in funding for the construction of the replacement jail through SB844 ($20 million) and SB863 ($2.8 million) legislation. On November 5, 2025, the State of California closed on its 2025 Series C tax-exempt Lease Revenue Bond sale to support these two legislative commitments for Napa County Detention and Rehabilitation Center.
As part of the Due Diligence process proceeding with the sale of the bonds, the State’s bonds counsel reviewed contracts that the Corrections Department currently had in effect and reviewed services that the department intended to contract for in the future. Some vendors were deemed to have a third-party interest in the facility. In instances where a third-party interest may exist, the State provided staff with boilerplate language to incorporate in its contracts.
The new contract language allows the State Public Works Board, Board of State and Community Corrections (BSCC), or the County of Napa to cancel the contract, without cause or penalty, with 50 days’ notice. In addition to the vendor and County signing the contract, a representative of the State Public Works Board and BSCC must also sign the agreement. Per the direction from the State Department of Finance, the State signatories must be last to sign.
Fortify Fire will inspect, test, and service all installed Fire Alarm Systems at Napa County Detention and Rehabilitation Center. They will also provide the necessary maintenance, including parts, for all listed types of alarm panels. Upon request by the County Department of Corrections Director or designee, the contractor will perform Non-Routine Services, including emergency services for the Napa County Detention and Rehabilitation Center as needed at times to bring the Fire Alarm Systems to basic operational condition (“Non-Routine Services”).
Fortify Fire Protection is not a local vendor.
Requested Action:
Approve and authorize the Chair to sign Agreement No. 260315B with Fortify Fire Protection for a term of June 2, 2026-June 30, 2029, with the provisions for two optional one-year automatic renewals.
