BACKGROUND

On August 24, 2025, pursuant to Government Code section 8630 and Napa County Code section 2.80.060, subd. (A)(2), the Napa County Executive Officer/Director of Emergency Services proclaimed a state of local emergency in response to the conditions of extreme peril that pertain to the safety of persons and property that arose from the Pickett Fire. On August 26, 2025, the Board of Supervisors adopted Resolution No. 2025-88, ratifying the proclamation and authorizing the emergency powers of County officials.

During the State of Local Emergency, the powers, functions, and duties of the Director of Emergency Services and the emergency organization of the County were those prescribed by state law, ordinance, and resolution of Napa County. On October 7, 2025, the Board of Supervisors continued the State of Local Emergency, maintaining the County's eligibility to receive mutual aid and other resources from the State or other agencies.  The current conditions resulting from the Pickett Fire no longer require the State of Emergency to remain in effect. 

A separate State of Local Health Emergency remains in effect regarding the imminent threat to public health and safety from the hazardous waste and materials from property sites within the 2025 Pickett Fire area.

If adopted by the Board, the proposed resolution will terminate the State of Local Emergency due to the Pickett Fire in Napa County and end the emergency powers of County officials as set forth in Resolution No. 2025-88 and in accordance with the Government Code.
