BACKGROUND

The Help America Vote Act (HAVA) provided Federal funds, Assistance Listing Number (ALN) 90.404, administered by the U.S. Election Assistance Commission (EAC) for activities to improve the administration of elections for Federal office, including to enhance election technology and make election security improvements, as authorized under sections 101, 103, 104 of HAVA.  The California Secretary of State is delegated the responsibility for the administration of these funds, including setting up necessary procedures for allocation of those funds.  Said procedures require the County to certify by resolution, the approval of contracts for distribution of said funds to Napa County. The proposed contract will provide $143,325 in funding for Napa County.


Information Technology Services has identified the following items as needed to enhance election security and recoverability: 1) battery backup and recovery for ITS locations at 1125 3rd St (Hall of Justice) and 1195 3rd St (Administration Building) totaling $76,700, of which $62,700 meets the County’s capital asset threshold requirements and $14,000 consists of related equipment that does not meet capitalization thresholds; and 2) server memory expansion to increase recovery speed in the event of an adverse incident and to support expanded security scanning and monitoring capabilities totaling $66,625, which consists of equipment below the capital asset threshold.

Sole Source Justification:  Fakouri Electric has a standing contract to provide all service for ITS owned Uninterrupted Power Supply units in multiple data centers. They retain proprietary maintenance schedule knowledge which is critical to our ongoing ability to safeguard data center equipment and business. For compatibility with existing equipment and consistency in service, Napa County needs retain Fakouri Electric.

This resolution and funding agreement will accept $143,325 in a Federal grant contract to enhance election technology as outlined above.  Approval of corresponding budget amendment is also requested.

Requested Actions:
1. Adopt a Resolution and authorize the Election Cybersecurity Reimbursement Contract with California Secretary of State; and
2. Authorize the purchase of a Battery Backup Redundancy device, a capital asset, in the amount of $62,700 and approve a waiver of competitive bidding requirements and sole source award to Fakouri Electric.
3. Approve a Budget Amendment for the following:
    Increase appropriations for computer related equipment and accessories in the amount of $80,625, (Fund 4200, Subdivision 4200010, account 53410); 
    Increase appropriations for a battery backup redundancy capital asset in the amount of $62,700, (Fund 4200, Subdivision 4200010, account 55400);
    Increase Federal Revenue of $143,325 (Fund 4200, Org 4200010, account 43890).

ENVIRONMENTAL DETERMINATION: The proposed action is not a project as defined by 14 California Code of Regulations 15378 (State CEQA Guidelines) and therefore CEQA is not applicable.
