BACKGROUND

The Public Works’ Property Management division has been managing minor water intrusion in select areas of the Administration building basement walls over the years with moderate success.  However, the water intrusion in room B-20 (formerly Risk Management Services, but now occupied by PBES staff) that occurred this winter required work outside the scope of general maintenance.

Therefore, Public Works staff sole sourced a California Uniform Public Construction Cost Account Act (CUPCCAA) contract with Rainbow Waterproofing and Restoration Co. (Rainbow) for $30,465 to perform waterproof epoxy injection on the basement wall.  Rainbow was sole sourced based on their unique, specialty service that has proven to be high quality and very reliable on their past projects performed on County facilities such as the Library, Hall of Justice elevator pit, and Jail kitchen floor, resolving water intrusion issues. In the past, the County has had difficulty attracting bidders for this type of work due to its specialty nature. For example, the County solicited bids for epoxy injection work on the Jail kitchen floor with 11 contractors showing interest and signed up to evaluate the project, however, only one contractor submitted a bid, Rainbow. The past work performed by Rainbow has resolved the water intrusion problems to date with no additional maintenance needed by Property Management.

This area of work in the Administration building basement has been sporadically problematic and minor over the years with the last maintenance effort lasting several years.  The event this winter, however, was more severe requiring the epoxy injection work recently performed.  During the epoxy injection work, the contractor discovered that the prior water proofing maintenance efforts on the wall had failed and needed to be removed prior to applying four new coats of water proofing and finishing paint.  The change order work associated with this item will accomplish the additional water proofing barrier without compromising the contractor’s warranty of their originally contracted work. After the contractor’s work is completed, Property Management will finish the wall with paint. The cost of the change order work, $14,950, exceeds the percentages allowed by public contract code without governing body approval and therefore needs to be approved by the Board of Supervisors. Public Works staff has already directed the contractor to perform the required work to avoid costs associated with mobilization and to maintain the shortest amount of time to prepare the needed space for occupancy by County staff.

Requested action:
1.  Approve and authorize Director of Public Works to sign a contract change order to the Admin Waterproof Injection, PW24-12 construction contract with Rainbow Waterproofing and Restoration Co. for a maximum not to exceed amount of $14,950.

The work is needed to prepare the space for occupancy and to maintain the warranty of the waterproofing work.

The work would need to be completed by property management staff or another vendor, which would void the contractor’s warranty and potentially increase maintenance cost or incur costs to bring the contractor back on site to address any leaks that occur after this work is complete.
