BACKGROUND
The State Water Resource Control Board (SWRCB) Water Quality Order, Phase II requires that the County implement measures to reduce sediment loading into the Napa River from County owned facilities. Working with the Napa Resource Conservation District, the County identified a culvert on Campbell Creek which flows under Dry Creek Rd. near the Lokoya Fire Station as a high priority for replacement. In addition to reducing sediment loading, this project which consists of replacing the culvert with a bridge also provides the added benefit of improved fish passage and some local flooding reduction near the fire station.
On February 8, 2022, the Board approved funding to start design of the project. By the following year, a significant amount of design was completed, and on January 24, 2023, the Board approved additional funding to help support applying for grants needed to fund the projects construction. The County then submitted a grant application to the SWRCB for $1,000,000 and to the Federal Highway Administration (FHWA) for $1,315,490. The County was later notified by both agencies that the project was selected for funding. Because the SWRCB grant was funded by the U.S. Environmental Protection Agency and the FHWA grant limits the amount of federal funding that can be combined in the project, the recommendation is that the County accept the larger of the two grants which is with FHWA. A final draft of this Culvert Aquatic Organism Passage (AOP) grant which was enacted by the Federal Infrastructure Investment and Jobs Act (H.R. 3684) was received from FHWA on August 1, 2024, and will be signed if the Board approves.
Since federal funding is involved, the County will need to comply with the National Environmental Policy Act (NEPA) review requirements and produce an environmental document for Caltrans to review and approve on behalf of FHWA. An additional $89,812 is being added to Stantec’s contract to support the additional work required to comply with NEPA and the contract is being extended two years because of the extra time needed for the FHWA process. The requested $155,046 budget amendment provides funding for the contract amendment and environmental surveys that will be needed prior to the start of construction. Funds that have been spent prior to signing the grant agreement are not reimbursable. The balance of the project is expected to cost $1,738,510 with our match being $423,020.
Requested Actions:
1. Approve Amendment No. 2 to Agreement No. 220242B with Stantec Inc. that increases compensation by $89,812; and
2. Adopt a Resolution authorizing the Director of Public Works to execute a grant agreement with FHWA for $1,315,490; and
3. Approve a Budget Amendment for the following (4/5 vote required):
a. Increase Transfer-Out appropriations by $155,046 in the SB-1 Non-Operating Special Revenue Fund (SB-1 SRF) (Fund 2440, Sub-Division 1220052, Account 56100) offset by use of its available fund balance to fund project 22012; and
b. Increase Construction Services appropriations by $155,046 in project 22012 (Fund 2040, Sub-Division 2040500, Project 22012, Account 52360) offset by a Transfer-In revenue from SB-1 SRF.

ENVIRONMENTAL DETERMINATION: The proposed action is not a project as defined by 14 California Code of Regulations 15378 (State CEQA Guidelines) and therefore CEQA is not applicable.
