Director of Public Works requests approval of and authorization for the Chair to sign Agreement No. 230242B with Ninyo & Moore Geotechnical & Environmental Sciences Consultants for a maximum of $300,000 per fiscal year and for the term from December 6, 2022 to June 30, 2027 for on-call services needed for construction testing and inspection on various upcoming building and paving projects.

EXECUTIVE SUMMARY
The County will be routinely completing building and roadway rehabilitation and repair projects which require testing, inspection and professional engineering support. Public Works advertised a request for statements of qualifications (SOQ’s) to seek out the most qualified firms to provide this service and is now ready to contract with the top ranked firm.

ENVIRONMENTAL IMPACT
ENVIRONMENTAL DETERMINATION: The proposed action is not a project as defined by 14 California Code of Regulations 15378 (State CEQA Guidelines) and therefore CEQA is not applicable.
BACKGROUND AND DISCUSSION
On July 6, 2022, the County advertised for statements of qualifications (SOQ’s) to seek out the most qualified firms to provide testing, inspection, geotechnical engineering and related services for building and road projects. Submitters were encouraged to submit qualifications for either building, road or both types of projects depending on their abilities. A total of seven SOQs (five for each category) were received. On September 1, 2022, the top ranked companies that submitted for the road category were interviewed in accordance with California Government Code Section 4526 and the County has since executed an agreement for the top ranked firm in this category.
On October 20, 2022, the top ranked companies that submitted for the building category were interviewed by staff and Public Works. The County is now ready to enter into an on-call professional service agreement with Ninyo & Moore (ranked most qualified). The County is also working on an on-call professional service agreement with the second most qualified (Inspection Services, Inc.) and will be seeking approval to enter in an agreement with them in the near future.
As tasks are identified, staff will request a proposal from the first ranked consultant and negotiate a fair price. In the event that the first ranked consultant and County are unable to come to a mutually acceptable fee for a particular task, staff will request a proposal from the second ranked consultant.
