BACKGROUND

Senate Bill No. 553 was signed on September 20, 2023 implementing Labor Code section 6401.9, requiring an employer to establish, implement, and maintain an effective Workplace Violence Prevention Plan (“WVPP” or “Plan”) by July 1, 2024. The purpose of establishing a WVPP is to have a clearly understandable, accessible, and actionable policy to respond quickly to the four types of workplace violence defined by Labor Code section 6401.9. The Plan outlines the steps to identify, report, analyze, and track violent incidents to reduce the likelihood of re-occurrence.

Napa County is committed to providing a safe and secure work environment for all employees, contractors, visitors, and volunteers and will make concerted efforts to prevent workplace violence incidents, including by following the requirements of this WVPP. Violence or the threat of violence against or by any employee or any other person will not be tolerated.

Key components to the proposed Workplace Violence Prevention Plan include but are not limited to:

                     Employee training on workplace violence awareness and prevention
2.
                     Risk assessments to identify potential hazards
3.
                     Clear reporting procedures
4.
                     Procedures for investigating workplace violence incidents and potential threats
5.
                     Procedures for taking corrective actions to address workplace violence risks
6.
                     Recordkeeping of workplace violence incidents

The Plan will be in effect in all work areas unless specified as excluded in the Plan’s Scope.

The WVPP is intended to complement the County’s existing employment policy for investigating and responding to workplace incidents. Employee training will be provided, and incident records will be maintained.

ENVIRONMENTAL IMPACT

ENVIRONMENTAL DETERMINATION: The proposed action is not a project as defined by 14 California Code of Regulations 15378 (State CEQA Guidelines) and therefore CEQA is not applicable.
