SUBJECT: Adoption of a Resolution Amending the Departmental Allocation List to Extend Limited Term Positions in the Napa County Probation Department

Director of Human Resources and Chief Probation Officer request the adoption of a Resolution amending the Departmental Allocation List for the Napa County Probation Department by extending the terms of four 1.0 FTE Deputy Probation Officer I/IIs - Limited Term through June 30, 2022, with no net increase in full-time equivalents, and no impact to the General Fund.

EXECUTIVE SUMMARY
If approved, this request will extend the term of staffing resources at the Napa County Probation Department which were included in the Budget Act of 2019 by the California Judicial Council (to the Napa County Superior Court) through June 30, 2022. The Court is required to contract with Napa County's Probation Department to perform required services. The positions are State funded under the scope of the award, and are earmarked for new Pretrial Programs that protect the public, and safeguard the rights of defendants by ensuring the fair and efficient administration of justice in pretrial decision-making.

Discretionary Justification: |
The 2019 Budget Bill language designates that the required services tied to the grant award can only be performed by county probation departments. To meet the obligations of the grant, current staffing must be extended to continue supporting this mandate. |

Future fiscal impact: |
The increased cost of salary and benefits for Fiscal Year 2021-2022 is estimated at $758,000 and will be absorbed by the remaining balance of the grant funding available to the County. There is no fiscal impact beyond Fiscal Year 2021-2022 due to the limited term designation of the requested positions. |

Consequences if not approved: |
If the terms of the limited term positions are not extended, the Probation Department will not meet the requirements of the Pretrial Programs required by the State award. Due to caseload assignments, existing staff cannot sustain the tasks/duties necessary to meet the Program goals, activities, and objectives. |

ENVIRONMENTAL IMPACT
ENVIRONMENTAL DETERMINATION: Not applicable.
BACKGROUND AND DISCUSSION
In the Budget Act of 2019, a State funded grant was awarded by the Judicial Council (policymaking body of the California Courts) to the Napa County Superior Court. Under the terms of the grant agreement, the Court must contract with the Napa County Probation Department to perform required services. The funding was earmarked for Pretrial Programs to support a judicial system that protects the public, ensures the rights of defendants, and provides for the fair and efficient administration of justice in pretrial decision-making. On November 11, 2019, the Board of Supervisors approved four Deputy Probation Officer I/II - Limited Term positions, with expiration dates of September 30, 2021, to ensure funds were spent in accordance with the grant requirements.
Subsequently, Senate Bill 129 (Stats.2021. Ch. 69) amended the Budget Act of 2021, providing additional funding for the continued operation of ongoing Pretrial Programs. With the remaining award balance from the Budget Act of 2019, and the new SB 129 allocation, the Limited Term positions are fully funded by the State, and it is requested that the term of these positions be extended through June 30, 2022.
Therefore, the Director of Human Resources and Chief Probation Officer recommend the adoption of a Resolution to amend the Departmental Allocation List as shown in Exhibit "A," effective September 18, 2021, with no net increase in full-time equivalents, and no impact to the General Fund.
