BACKGROUND

The old Dry Creek Road Bridge over Dry Creek was 0.8 miles west of Mt. Veeder Road, over 100 years old, and in need of replacement. Caltrans identified the bridge as structurally deficient, functionally obsolete, and unstable due to scour under the north abutment. The width was only 18 feet between the bridge barriers, which does not meet the Association of State Highway and Transportation Officials (AASHTO) standard of 11-foot minimum lanes.

The new bridge structure consists of an approximately 80-foot-long by 32-foot-wide single-span concrete slab bridge that is constructed on pre-cast and pre-stressed concrete girders. The project also includes 900 feet of new roadway that removed two curves in Dry Creek Road. Caltrans has been reimbursing Napa County 100% of eligible and participating costs.

After County staff conducted a competitive solicitation for construction management services and the Board awarded Agreement No. 250223B to Bureau Veritas on November 12, 2024. The original Agreement’s scope was limited to constructability review to address potential issues and conflicts before the construction work was advertised to bidders.

On May 6, 2025, the Board awarded the competitively bid construction contract to Gordon N. Ball, Inc., approved Amendment No. 1 to Agreement No. 250223B with Bureau Veritas for additional pre-construction services, and approved a budget amendment for the construction phase.

On May 20, 2025, the Board approved Amendment No. 2 to Agreement No. 250223B with Bureau Veritas for construction management and post-construction services through construction.

Gordon N. Ball plans to finish construction at the Dry Creek Bridge Project under budget and on schedule in October 2026. When County staff and BVNA staff negotiated agreement 250223B, there was an assumption that Gordon N. Ball would not work in December 2025 through March 2026; however, they did work when the weather was favorable. As a result, Bureau Veritas staff worked through the winter of 2025-2026, which increased the construction management and testing costs as described in their amendment proposal.

County staff negotiated Amendment No. 3 to Agreement No. 250223B, County Counsel approved it as to form, and staff recommends approval of Amendment No. 3 for additional Task 2 - Construction Services and Task 3 - Post-construction Services.

Requested Actions:

1.                     Approve Amendment 3 to Agreement No. 250223B to Bureau Veritas of Sacramento, California for an additional $497,945 to increase the maximum not to exceed amount from $1,265,796 to $1,763,741, for construction and post-construction services; and

2.                     Approval of a Budget Amendment to increase appropriations in project 14009 - Dry Creek Bridge - Dry Creek in the Roads Fund (Fund 2040, Sub-Division 2040500) in account 52360 - Construction Services in the amount of $497,945 offset by use of its available fund balance.

FISCAL IMPACT

Is there a Fiscal Impact?

Yes

Is it currently budgeted?

No

Is it Mandatory or Discretionary?

Discretionary

Discretionary Justification:

The Public Works Department does not have adequate staff nor staff with the specialized training to manage the construction and inspection of the bridge. Construction management services are necessary to keep the bridge replacement on schedule and in compliance with FHWA and Caltrans requirements.

Is the general fund affected?

No

Future fiscal impact:

It is anticipated that the construction management work will end in fiscal year 2026-27.

Consequences if not approved:

Napa County would need to renegotiate the amendment.

Additional Information

Dry Creek Road is designated as a “minor collector”, the existing bridge is an “Off-System" bridge and thus the project is eligible for 88.53% Highway Bridge Program (HBP) funding and 11.47% Toll Credits funding as the match for local funds; however, there are some expenses that are ineligible for federal funding. In Fiscal Year 2016-17, the Board budgeted $958,420 from the Roads Fund to cash flow the consultant and County staff expenses during design/engineering. On July 13, 2021, the Board approved Amendment 1 with BCA and a $321,054 budget transfer from the Measure T/U fund. On December 14, 2021, the Board approved Amendment 2 with BCA and a $133,150 budget transfer from the Measure T/U fund. On June 7, 2022, the Board approved Amendment 3 with BCA and a $900,000 budget transfer from the Accumulated Capital Outlay Fund (ACO). On November 8, 2022, the Board approved a $200,000 budget transfer from the ACO for right-of-way acquisitions. On February 28, 2023, the Board approved Amendment No. 4 and a $600,000 budget transfer from the ACO. On September 24, 2024, the Board approved Amendment No. 5 and a $175,000 budget transfer from the ACO. On November 12, 2024, the Board approved the Agreement with Bureau Veritas and a $287,264 budget transfer from the ACO. On May 6, 2025, approved a $9,056,050 budget transfer from the ACO.
