BACKGROUND
Since October 1, 2020, pursuant to Napa County Agreement No. 210168B, Napa Roots Landscaping has been providing brush clearing and fire hazard abatement services as part of Napa County’s Fire Hazard Abatement Program. Since June 8, 2021, Napa Roots has also been providing fire prevention management services for County-owned properties under this agreement. Approval of the proposed amendment would extend the term of the agreement for both critical fire hazard mitigation services and update hourly compensation rates. Maximum compensation will be $155,000 per fiscal year, $80,000 for fire abatement services and $75,000 for fire prevention services on County-owned parcels.
On June 22, 2007, the County adopted the Napa County Fire Hazard Abatement Ordinance. Staff from County Fire have been inspecting properties for compliance under this Ordinance throughout the County focusing on high-risk communities and responding to neighborhood and community concerns. Properties that are not in compliance with the defensible space requirements are issued a “Notice to Abate Fire Hazard.” After 14 days, if the property is still not in compliance, the County will use a private contractor to reduce the fire hazard, and the property owner will be billed for the cost of the contractor and cost of the fire department staff.
On November 10, 2020, Napa County Agreement No. 210168B was executed, and Napa Roots became one of the contractors providing fire abatement services to the County Fire Department. On or about April 1, 2021, Amendment No. 1 to the Agreement was executed to increase maximum annual compensation for fire hazard abatement work. On June 8, 2021, with notification that State-assigned fire crews could no longer provide fire prevention management services for County-owned parcels, Amendment No. 2 to the Agreement with Napa Roots was executed to expand the scope of work to include fire prevention management services for County owned parcels that are predominantly vacant and in fire-hazard areas. On June 27, 2023, Amendment No. 3 extended the fire hazard abatement services and to update hourly compensation rates, Amendment No. 4 is requesting them to do the same.
Napa Roots Landscaping is a local vendor and was selected by Napa County Fire through a request for quote process. The effective date reflects dates of services provided prior to agreement being in place.
Requested Actions:
1. Approval of and authorization for the Chair to sign Agreement No. 210168B Amendment No. 4 with Napa Roots Landscaping to extend term, July 1, 2026, through June 30, 2027, with an automatic annual renewal provision for up to two years.
2. Update compensation rates with a not to exceed annual maximum compensation of $155,000.

Discretionary Justification: |
The Professional Services Agreement is necessary to implement the Napa County Fire Hazard Abatement Ordinance and is necessary to carry out fire prevention measures on County-owned parcels. For fire hazard abatement on private property, property owners will be billed for the cost of the contractor and the cost of the fire department staff time for the abatement. Nonpayment will be turned over to the County Treasury as an assessment against the affected parcel of land. |

Consequences if not approved: |
The Napa County Fire Department utilizes this contractor to abate fire hazards throughout the county and Public Works utilizes this contractor to conduct fire prevention work on County-owned parcels. The lack of qualified or willing contractors within the County is limited. Not approving this amendment would hamper the Fire Department and Public Works efforts in fire prevention, causing increased risk to the citizens of Napa County. |
