Director of Housing and Homeless Services requests the following:
1. Approval of and authorization for the Chair to sign Amendment No. 1 to Agreement No. 220014B with Kristin Lowell, Inc. to (1) assist with evaluation of existing acreage within County Service Area No. 4 (CSA No. 4); (2) prepare Engineer’s Report; and (3) provide related services supporting the County’s actions to conduct balloting and other required procedures for the reauthorization of CSA No. 4. under Proposition 218; and
2. Approval of a Budget Transfer No. 22-151 to increase appropriations by $7,200 in Fund 2810 (Subdivision 2810000, Account 52145 Engineering Services) offset by use of available fund balance. (4/5 vote required)

EXECUTIVE SUMMARY
The proposed action will approve two actions: First, obtain the services of an assessment engineer required by law for the preparation of an Engineer’s Report for Fiscal Year 2022-2023 that needs to be paid in Fiscal Year 2021-2022. This is a prerequisite action that will allow the Board, at a later date to take the necessary actions to determine and levy the amount of the annual assessment on owners of planted vineyard acreage within County Service Area No. 4 to provide funding for farm worker housing. Second, the action will increase appropriations in Fund 2810 County Service Area No. 4, Subdivision 2810000-52145 Engineer Services by $7,200 offset by use of available fund balance.

ENVIRONMENTAL IMPACT
ENVIRONMENTAL DETERMINATION: The proposed action is not a project as defined by 14 California Code of Regulations 15378 (State CEQA Guidelines) and therefore CEQA is not applicable.
BACKGROUND AND DISCUSSION
Pursuant to Government Code section 25210 et seq., the Napa County Board of Supervisors each year shall either adopt or revise the estimate of money required for the purpose of providing the extended service of farm worker housing within County Service Area No. 4 (CSA No. 4) for the succeeding fiscal year.
The amended agreement specifies contractor will provide the following services for FY 2022/2023:
1. Assist the County in updating their database of existing planted vineyard acreage within the CSA#4 area.
2. Calculate each parcel's assessment. The assessment for each parcel is in direct relationship to the benefit each parcel receives from the farmworker housing. The relative responsibility will be based on the benefit nexus between the amounts of special benefit each parcel receives from farmworker housing relative to the amount of benefit all other parcels receive.
3. Prepare the CSA#4 Farmworker Housing Assessment District Engineer's Report.
4. Assist the County in preparing, compiling and mailing the public notice and ballot to each property owner in compliance with Article XIIID, Sections 4(c) and (d) of the California Constitution. Consultant will prepare and compile the notice and ballot, and prepare them for mailing, and the County will be responsible for postage and mailing. In accordance with Article XIIID, Sections 4(c)(d), each parcel owner identified in CSA No. 4 will receive a public notice which contains: Amount of proposed assessment, total amount chargeable to the entire CSA No. 4, amount chargeable to owner's particular parcel, duration of the payments, reason for the assessment and basis upon which the amount of the proposed assessment was calculated, and a ballot for the parcel owner to support/oppose of the proposed assessment.
5. Submit the assessments to the County Auditor's office for them to include the assessments on the property tax bills.
6. Attend (2) meetings as follows: one meeting with the Board of Supervisors to approve the Resolution of Intention and the second meeting when the Board of Supervisors holds the public hearing and tabulates the assessment ballots.
Based upon a successful ballot initiative, the assessment will continue for another five year period at a rate not to exceed $15.00 per planted acre.
Today’s action approves Amendment #1 to Agreement No. 220014B to include the scope of work necessary to prepare for the renewal of CSA No 4 assessment beginning in Fiscal Year 2022-2023, and approves increasing appropriations by $7,200 in Fund 2810 Subdivision 2810000, offset by use of fund balance, for the contract increase.
