BACKGROUND

Human Resources and County Counsel drafted a new Lactation Accommodation Policy in accordance with Federal and State law. In addition to providing reasonable break time to express milk, employers must provide a private lactation space, other than a bathroom, that must be near the employee’s workplace, is shielded from view, and is free from intrusion when the employee is using the space. Further, the private lactation space must be safe, clean, and free from hazardous materials, and contain a surface to place a breast pump and personal items, a place to sit, and have access to electricity or alternative devices, including, but not limited to, extension cords or charging stations needed to operate an electric or battery-powered breast pump. Employers must also provide access to a sink with running water and a refrigerator suitable for storing milk. If a refrigerator is not feasible, the employer should provide another cooling device. For non-traditional worksites, the policy allows for an interactive process to identify reasonable accommodations to support an employee’s ability to express milk at the workplace. 

The Lactation Accommodation Policy includes instructions on how an employee can request an accommodation, how the employer will respond, and how an employee can file a complaint.

The County has fulfilled its meet and confer requirements with the employee bargaining groups.

Requested Action:
Adopt a resolution to amend the Napa County Policy Manual Part I to add Section 37DD - Lactation Accommodation Policy.

ENVIRONMENTAL DETERMINATION: The proposed action is not a project as defined by 14 California Code of Regulations 15378 (State CEQA Guidelines) and therefore CEQA is not applicable.
