SUBJECT: Approval of Amendment No. 1 to Professional Services Agreement 240283B with Bureau Veritas for the Chiles Pope Bridge Replacement Project.

BACKGROUND
On January 23, 2024, the Board awarded a construction contract to Gordon N. Ball of Alamo, CA for the Chiles Pope Valley Road Bridge over Chiles Creek Project, RDS 15-23. Gordon N. Ball’s bid was $6,246,113 and at award the Board also approved a budget amendment of $9,181,038 to fund the construction.
The Chiles Pope Valley Road Bridge over Chiles Creek Project, is approximately 2.1 miles north of Highway 128 and was replaced in the spring, summer, and fall of 2024, and only minor bridge construction work remains. For example, installing the irrigation system and plants for the California Department of Fish and Wildlife required mitigation is a separate project that will take place this summer.
On February 24, 2024, the Board approved an agreement with Bureau Veritas to provide construction management services. Due to geotechnical complications during construction, additional construction support services were and are required from the Bureau Veritas construction management team to close out the Project. The complications arose from the contractor filing a claim by demanding extra compensation due to harder than expected drilling environment, which required additional inspection and support services. The drilling claim from Gordon N. Ball is for roughly $1.5 million and may require mediation, arbitration, and potentially going to court for resolution.
The project is expected to receive an 88.53% federal reimbursement ($8,127,973) and requires a 11.47% local share ($1,053,065). All reimbursements will be returned to the source of the original funds (Roads or CIF) for use on future projects. The cost of this amendment is within the funding level previously approved by the Board, so no Budget Transfer is needed.
Requested Action:
1. Approve and authorize Amendment No. 1 for Agreement No. 240283B with Bureau Veritas increasing the total compensation under the Agreement by $310,152 for a new contract total of $1,205,925.

Additional Information |
In Fiscal Year 2016-17, the Board budgeted $892,024 from the Roads Fund to cashflow the consultant and County staff expenses during design/engineering. On March 22, 2022, the Board approved a budget transfer of $400,160 to allow the County to use the CIF (Capital Improvement Projects Fund) to cash flow the design and engineering. On November 11, 2024, the Board approved a $300,000 budget amendment for Project 25014. |
