SUBJECT: Second Amendment to Professional Services Agreement No. 170284B with Employee Relations, Inc.

RECOMMENDATION
title
Approve and authorize Amendment No. 2 to Agreement No. 170284B with Employee Relations, Inc. increasing the maximum annual amount to $60,000 for the term effective July 1, 2024, through June 30, 2029, with an option to extend for two additional years through June 30, 2031, to conduct comprehensive employment background investigation services. (Fiscal Impact: $60,000 Expense; General Fund; Budgeted; Discretionary)
body
BACKGROUND
In 2006, the County began contracting with Employee Relations, Inc. to obtain pre-employment background investigative services on prospective employees. California State Association of Counties (CSAC) formally selected Employee Relations, Inc. in February 2011 through an RFP process to provide pre-employment background investigative services to its affiliated public agencies, including Napa County.
AB 1008 took effect January 2018 and prohibited employers from asking for and evaluating criminal history information on prospective candidates prior to a conditional offer being extended. Since then, the County has relied more heavily on the pre-employment background check process to ensure that prospective employees do not pose a reasonable risk to the County due to information found in a background check. The services offered by Employee Relations, Inc. provide critical background information including criminal history, education verification, checks of special licenses and certifications, former employment verification, reference checks, and credit checks.
Amendment No. 2 extends the contract term, increases the annual contract maximum amount from $40,000 to $60,000, and allows Human Resources to pay for services already rendered and to continue providing this critical service to hiring departments.
