BACKGROUND

The Napa County Department of Corrections (NCDC) previously offered educational services to the incarcerated population via a Memorandum of Understanding (MOU) with the Napa Valley Unified School District (NVUSD).  Classroom space was available in the basement of the North Jail.  That previous space has not been available since the 2018 construction of cells in the north jail’s basement.  No other space appropriate for programming is available at the current jail.  Programming spaces will be available in the replacement jail. 

This MOU will reinstate education services, such as General Education Development (GED) certificate of high school equivalency at the replacement jail. 

Requested Action:

1.Approve and authorize MOU No. 8699 with the Napa Valley Unified School District Adult Education for the term of July 22, 2025, through June 30, 2026.

Discretionary Justification:

Napa County Department of Corrections recognizes the value of offering educational opportunities to the incarcerated population.  This MOU will help increase the likelihood of employment and self-sufficiency to incarcerated persons re-entering the community.

Consequences if not approved:

Incarcerated persons will not have the opportunity to enrich their education while serving their sentence.

Additional Information

On 12/3/2024, MOU No. 8685 with NVUSD with a five-year term was approved by the Board.  NCDC was recently informed by NVUSD that the district is unable to enter into agreements of more than one year in duration.  The term of MOU No. 8699 is one-year and will replace MOU No. 8685.

ENVIRONMENTAL DETERMINATION: The proposed action is not a project as defined by 14 California Code of Regulations 15378 (State CEQA Guidelines) and therefore CEQA is not applicable.
