BACKGROUND

California Food and Agricultural Code §2122 and California Business and Professions Code §12200 require that the Agricultural Commissioner and the Sealer of Weights and Measures be appointed to four-year terms. The Agricultural Commissioner and Sealer of Weights and Measures is a consolidated position in Napa County.

On April 3, 2021, Tracy Cleveland (Cleveland) began her four-year term as the Agricultural Commissioner/Sealer of Weights and Measures. Cleveland has over 22 years of experience within the Napa County Agricultural Commissioner’s office. She started with the Department in 2003 as an extra help plant inspector, worked as an Ag/Weights & Measures Inspector in the Pesticide Use Enforcement program for 11 years, became the Pest Detection Deputy in 2014, the Assistant Agricultural Commissioner/Sealer of Weights and Measures in 2016, the interim Agricultural Commissioner/Sealer of Weights and Measures in 2020 before being appointed as the Agricultural Commissioner/Sealer of Weights and Measures in 2021. Cleveland and her team are responsible for promoting agriculture, protecting people and the environment, as well as promoting equity within the marketplace for both consumers and businesses in Napa County. Cleveland has a Bachelor of Science degree in Ecology from Sonoma State University.

This employment contract amendment reflects another four-year term effective April 3, 2025 through April 2, 2029, includes the standard employment contract provisions, incorporates by reference the most recent version of the Management Compensation Plan applicable to Management - Non-Classified Employees, and includes the relevant provisions of California Food and Agricultural Code and Business and Professional Code.

Requested Action:
1. Reappoint Tracy Cleveland as the Agricultural Commissioner/Sealer of Weights and Measures, effective April 3, 2025.
2. Approve and authorize Amendment No. 1 to Agreement 210327B with Tracy Cleveland, effective April 3, 2025.

Reappointment at Step 5 of the pay scale; annual salary and benefits total approximately $298,156 and subject to various annual cost increases will be appropriated in the Ag Commissioner-Sealer Fund.

ENVIRONMENTAL DETERMINATION: The proposed action is not a project as defined by 14 California Code of Regulations 15378 (State CEQA Guidelines) and therefore CEQA is not applicable.
