BACKGROUND

In April 2002, the Board of Supervisors adopted Ordinance No. 1196, adding Chapter 2.58 to the Napa County Code and establishing the In-Home Supportive Services (IHSS) Public Authority of Napa County as authorized by Section 12301.6 of the Welfare and Institutions Code (WIC). A Total Tentative Agreement (TTA) was reached December 18, 2023 between the Napa County IHSS Public Authority and SEIU Local 2015 for a successor Memorandum of Understanding (MOU), effective February 6, 2024 through June 30, 2027.

Upon approval of the MOU by the IHSS Public Authority Governing Board, the IHSS Public Authority must submit a rate change request package to the California Department of Social Services (CDSS) to implement the negotiated increase to wages and continued health benefit.  The successor MOU establishes an hourly wage increase from $17.45 to $20.00, a Health Benefit amount of $0.40, a Non-Health Benefit (Personal Protective Equipment) amount of $0.01, and a Payroll Tax rate of $1.53. The IHSS Public Authority Administrative Rate will continue at $0.33.  The new IHSS Public Authority Rate will be $22.27.

On July 6, 2018, CDSS issued All County Letter 18-79 providing guidance to IHSS Public Authorities on the rate change request process. CDSS requires that requests for changes to the IHSS Public Authority Rate be made at least 60 days but not more than 90 days prior to the requested effective date. Any change made to the rate shall take effect commencing the first day of the month following final approval received by CDSS and the California Department of Health Care Services (DHCS). The effective date for these changes to the IHSS Public Authority Rate is May 1, 2024.

Upon approval of this resolution and when the MOU between the IHSS Public Authority and SEIU Local 2015 is approved by the IHSS Public Authority Governing Board, HHSA will submit a rate change package to CDSS to obtain approval from CDSS and DHCS.

Future fiscal impact:

The IHSS Maintenance of Effort (MOE) will be adjusted to account for the County’s share of the increases in wages and will result in an increase of approximately 5.4 million over the term of the MOU.

Consequences if not approved:

IHSS providers would not receive the increase in wages bargained for during negotiations.

 

ENVIRONMENTAL IMPACT

ENVIRONMENTAL DETERMINATION: The proposed action is not a project as defined by 14 California Code of Regulations 15378 (State CEQA Guidelines) and therefore CEQA is not applicable.
