RECOMMENDATION

Director of Public Works requests the following actions regarding repairs to Steele Park Culvert:
1. Receive and review report of emergency public work actions in response to the event (see attached Memorandum), accomplished without competitive bidding as authorized by Resolution No. 2015-37;
2. Confirm that based on the report from Public Works, that the emergency does not permit the delay associated with competitive bidding procedures, and that the emergency actions are necessary to respond to the emergency pursuant to Public Contract Code section 22050 (4/5 Vote Required);
3. Creation of a new Lake Berryessa Concessions Capital Project 24018 (Fund 5080, Sub-division 5080500) for the Steele Park Culver Repair Project;
4. Approval of Agreement No. 240222B for Eakle Construction and Trucking of Pope Valley, California for $119,014 and authorize County Executive Officer to sign the Professional Services Agreement for the Steele Park Culvert Repair Project; and
5. Approval of a Budget Amendment for the following (4/5 vote required):
a. Increase Interfund Transfers Out appropriation by $119,014 in the Accumulated Capital Outlay Fund (ACO) (Fund 3000, Sub-division 3000000, Account 56100) with use of its available fund balance; and
b. Increase Construction Services appropriations by $119,014 in Lake Berryessa Concessions Project 24018 (Fund 5080, Sub-division 5080500, Account 52360) budget with offsetting revenue from the transfer from the ACO.

EXECUTIVE SUMMARY
A critical drainage system that collects stormwater runoff within the Steele Park Resort and Berryessa Highlands Unit 1 Subdivision catchment basin experienced a structural collapse approximately 200 feet from lake shoreline resulting in surcharged flow over a paved access road during moderate-to-severe atmospheric river storms. Multiple repair alternatives were considered by County staff and a Consultant to restore intermittent flow continuity in the 36 inch diameter culvert. Immediate action is necessary to replace 200 foot segment of the culvert from a sinkhole to the inlet pool in proximity to Steele Park storage facilities and paved access drive to camping areas on the Resort grounds.

ENVIRONMENTAL IMPACT
Consideration and possible adoption of a Categorical Exemption Class 1: It has been determined that this type of project does not have a significant effect on the environment and is exempt from the California Environmental Quality Act. [See Class 1 (“Existing Facilities”) which may be found in the guidelines for the implementation of the California Environmental Quality Act at 14 CCR §15301; see also Napa County’s Local Procedures for Implementing the California Environmental Quality Act, Appendix B.]
BACKGROUND AND DISCUSSION
Please see the attached Memorandum from Chris Silke dated October 27, 2023, for a detailed description of the project, photographs, contractors contacted to perform repairs, and the various repair options considered. The County proceeded with Option No. 2, as indicated in the Memorandum.
Delays associated with the preparation of plans and specifications, advertising and awarding a contract for repairs would be detrimental to the County. Immediate repair is necessary to prevent further damage to the facility with the upcoming rainy season, to prevent further erosion which could wash sediment into Lake Berryessa, and to remove sinkholes that present a potential hazard to the public. The County Executive Officer is authorized to proceed with emergency projects, subject to ratification by the Board, pursuant to Resolution 2015-37 (attached) and Public Contract Code section 22050.
